General Questions
1. Why am I getting a bill from Beaver Park Water, what is it for?
Beaver Park Water, Inc. (BPW) is the owner of water rights located on Pikes Peak ’s southern slope. We are a mutually owned, not-for-profit ditch company-which simply means that the owners are the shareholders themselves. You are a shareholder in Beaver Park Water, Inc. This ownership entitles you to shares of available irrigation water delivered to the nearest existing distribution point to your property.
2. I want to pass on irrigation..why do I have to pay?
Yearly assessments are not payment for water. BPW is owned by the shareholders-it is their company. A good part of the assessment goes toward retiring the debt incurred when BPW purchased the water rights, ditches, pipelines, land and reservoir in the late 1970s. There have also been numerous upgrades to the system as well as reconstruction of Brush Hollow Reservoir in the early 1990s. In addition to the debt retirement and system upgrades, the assessments cover maintenance and repair of the system; operational items such as fuel, insurance, wages, and legal fees. Shareholders vote at the Annual Meeting to accept the yearly budget and the Board uses the accepted budget to determine assessment fees.
3. When will I receive the statement and when is payment due?
Assessment notices are mailed in March. Payments can be made in two installments with the first half plus a $10.00 service charge due by April 1st and the second half due by August 1st.
4. What if I do not pay the assessment?
If the first half assessment is not paid by April 1st, it becomes delinquent. A 10.00 service charge will be added and the first half balance due would bear interest at the rate of eighteen percent per annum computed on a monthly basis from the date of delinquency until paid. If the second half is not paid by August 1, the total assessment due and the service charge shall bear interest at the rate of eighteen percent per annum computed on a monthly basis from the date of the delinquency until paid.
The Company By-Laws state that no water will be delivered to shareholders who are delinquent on water assessments or any monies due to BPW.
5. What if I do not pay the next year?
When an assessment becomes delinquent, the interest continues to accrue at the rate 18% per annum computed on a monthly basis from the date of the delinquency until paid.
The Board of Directors provide that delinquent shares, where assessments have not been paid for 2 years, will be auctioned to the highest bidder at the next annual meeting.
The Company By-Laws state that no water will be delivered to shareholders who are delinquent on water assessments or any monies due to BPW.
6. Can I sell my water?
Your water shares can be transferred to another landowner in accordance with BPW policies and line restrictions. Any monetary transaction is between landowners.
7. What are the lease and transfer line restrictions?
Because of the dynamics of our water distribution system, Lines 2, 6A, 6B, 9 and Upper Ditch are restricted from leases or transfers which come from a different line. Leases, transfers, and sales to these restricted lines must come from the same line.
Exceptions to the restrictions must be presented to the board of directors for a vote of approval.
8. If I own water shares on different sites, can I transfer part or all from one site to another?
Yes, but for full year increments only and in accordance with BPW policies and line restrictions. Completed forms must be submitted to the superintendent and recorded by April 1.
Lease Forms for the irrigation season are available on line, at the BPW office and from your Ditch Rider.
